Terms and Conditions

  1. Where ‘Fan Page’ is stated, it refers to the official Total Eclipse Facebook Fan Page.
  2. When you submit a hidden object scene photograph as a post entitled “Hidden Object Birthday Contest”(henceforth known as “Accepted Entry”)  through the Fan Page you will be entered into the contest organised by Total Eclipse, and named “Total Eclipse Hidden Object Birthday Contest” (henceforth known as “Contest”).
  3. All submission descriptions must be in English.
  4. By taking part in this Contest, through a submission of an Accepted Entry, you agree to be bound by these Terms and Conditions and all decisions of the administrators, who are employees of Total Eclipse and whose decisions and announcements with respect to all aspects of the contest and its winners are final and binding.
  5. Facebook has no affiliation, indirect or direct involvement with this Contest.
  6. Multiple Accepted Entries are allowed. Votes (likes) from multiple submissions by the same individual will NOT be added together. Each Accepted Entry is considered separately.
  7. The Contest is open to all except employees of Total Eclipse and their immediate family. “Immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” Employees of Total Eclipse games might submit instructional photographs which will be clearly marked as such and will not qualify for the Contest as valid entries.
  8. Should you submit an Accepted Entry while being under 18 years of age, you must obtain parental or legal guardian consent prior to doing so. Total Eclipse games reserves the right to request such consent. Any such request will be in writing at any time through the Contest duration.
  9. NO PURCHASE IS NECESSARY TO PARTICIPATE IN THIS CONTEST; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.
  10. By submitting an Accepted Entry you confirm that any photographs were created by you. Accepted Entries MUST NOT include people’s faces. Any photos including people’s faces will be removed by administrators and related Entries will be disqualified.
  11. No offensive content of any format will be accepted.  Total Eclipse retains the right  to remove and disqualify any such Entries.
  12. Please take all safety precautions while taking photographs and ensure you have appropriate permissions for private property shoots. It is your responsibility to ensure that you have permission for the photographs to be entered into the Contest, posted on the Fan Page and made publicly available. In case of dispute or privacy breaches, Total Eclipse will not be held responsible and reserves the right to remove and disqualify such Entries.
  13. Total Eclipse accepts no responsibility for submissions which are lost or damaged during the upload process.
  14. All Accepted Entries submitted to the Fan Page between 00:00 GMT +2 25 December 2009 (the "Opening Date") and 23:59 GMT +2  31 January 2010 (the "Closing Date") will be automatically entered into the Contest. Late entries will be disqualified.
  15. Total Eclipse reserves the right to extend the contest if deemed necessary.
  16. At the Closing Date and during a period of one week, all votes from all Accepted Entries will be counted and the winners announced. In case of a draw, a ballot will be thrown.
  17. Your submission of an Accepted Entry signifies your agreement that Total Eclipse receives an irrevocable and royalty-free right to reproduce and use the content of that entry for any purposes of the Contest and related publicity material.
  18. By submitting an Accepted Entry you guarantee that it is in your full right to provide such an Accepted entry and allow use of it by Total Eclipse, in full accordance with these Terms and Condition
  19. You agree to not hold Total Eclipse responsible for any cost, loss, liability or expense incurred as a result of any claim, demand, or litigation by any third party due to or arising out of any Accepted Entry that you submit to the Fan Page.
  20. At the Closing Date, no further submissions will be possible. Total Eclipse staff will count the votes under each Accepted Entry and proceed to announce 10 winners. The order of winners depends on the maximum number of votes. Prizes are as follows:

    1st winner:

    • Become a character in the next Total Eclipse game production.
    • Receive a copy of all Total Eclipse games to date.
    • Will subsequently receive all upcoming Total Eclipse games, including The Clockwork Man 2.
    • A poster from The Clockwork Man.

    Winners 2-5:

    • A copy of The Clockwork Man 2 on release date.
    • A poster from The Clockwork Man.

    Winners 6-10:

    • A copy of The Clockwork Man 2 on release date.
  21. The winning entries will be published and featured in the Total Eclipse Fan Page, the Total Eclipse Twitter feed and the Total Eclipse Website.
  22. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner.
  23. Winners will be notified a week after the Closing Date.  A list of the winners will be available on the Total Eclipse site following the notification and will remain available.
  24. To claim a prize, proof of age, identity and parent or legal guardian consent (where appropriate) may be required.
  25. No cash or alternative prizes to be provided.
  26. Total Eclipse reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value.
  27. The prize winners may be asked to participate in publicity and promotional activities.
  28. Total Eclipse reserves the right to make changes in the contest terms and conditions at any time, which changes will become effective without notice. Participants are subject to the most current version of the Terms and Conditions in effect.
  29. These Terms and Conditions shall be governed by and construed in accordance with Greek  law. You hereby submit to and agree that the sole jurisdiction and venue for any actions that may arise under or in relation to the subject matter hereof shall be the Greek  courts.
